1. Who is eligible for a work permit?

  • Being at least 18 years old.
  • Having good health that meets the job’s specific requirements.
  • Having no criminal record in their country, free from national security offenses, not currently undergoing criminal prosecution, and not serving a criminal sentence, as verified by Vietnamese as well as foreign law enforcement during the assignment.

In addition, the requirements can vary depending on the job positions as follows:

  • Foreign experts
    • Having a bachelor’s degree or higher, a certificate of at least 3 years of relevant experience in the trained field relating to the expected job in Vietnam; or
    • Possessing a certificate of at least 5 years of experience in the relevant field for the job position in Vietnam.
  • Technical Workers
    • Completing at least 1 year of training in technical or related fields and having at least 3 years of experience in that field; or
    • Having a certificate of at least 5 years of work experience in a position that meets the intended job in Vietnam.
    • The company where the foreigners are employed must have a business registration certificate.
  • Directors, CEOs, etc
    • Deciding on the appointment.
    • Possessing a certificate of at least 3 years of relevant working experience in the job position.

2. How to apply for a work permit?

The process to get a work permit in Vietnam involves specific procedures and document submissions that both the employer and foreigners must follow:

Step 1: Request approval for using foreign workers

The employer is required to apply for approval of using foreign workers at least 30 days before the expected start date of the foreign worker at the company. The essential documents include:

  • Registration form for employing foreign workers
  • A copy of the business registration.
  • Letter of attorney if the submitter is not the enterprise’s legal representative.

After that, these documents can be applied in two ways:

  • Send directly to the Ministry of Labor, War Invalids and Social Affairs or the People’s Committee of the province where the foreign worker is expected to work.
  • Send online via http://dvc.vieclamvietnam.gov.vn

It takes 15 working days for direct submission and about 12 working days for online submission.

Step 2: Prepare the required documents for the Vietnam work permit

The foreigner is required to prepare the following documentation:

  • Application form for the Vietnam work permit 
  • Original health check conducted in Vietnam, or if obtained abroad, a legalized health check certified Vietnamese translation. The health check needs to be issued within the 12 months.
  • Original Vietnam Police Check or, if conducted abroad, a legalized police check with its certified Vietnamese translation, issued within the last 6 months.
  • Certified copy of a valid passport.
  • Approval letter obtained during Step 1.
  • Two passport-sized photos (refer to photo requirements).
  • Legalized copies of documents substantiating the foreigner’s eligibility for the applied position, along with their certified Vietnamese translations.
  • Quantity: 01 set.

Step 3: Submit the required documents to get Vietnam work permit

The foreigner is required to send the documents to the Ministry of Labor, War Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs of the province where they plan to work at least 15 days before the expected start date of the foreign worker at the company.

Step 4: Receive the result

The foreigner will receive the work permit in Form 12/PLI within 05 working days after sending all documents. In the event of a rejection, the employer will receive clarifications regarding the refusal.
